Psychologists often debate over adaptive and maladaptive behaviors for coping with stress. Some argue that certain defense mechanisms such as denial or avoidant coping (wishful thinking) are effective in eliminating the effects of stress on mental and physical health while others disagree.

In your opinion, is the use of defense mechanisms, or avoidant coping, an adaptive or maladaptive way to cope with stress? Why or why not? Support your reasoning with information from the text and other course materials.

Constructive Eviction and the Implied Warranty of Habitability

Steve is renting a property from Billy. One evening Steve tripped and fell down the stairs. The issue is that one of the stairs in the common area was faulty. Billy knew about the stair, but he had never got around to fixing it.

Steve injured his leg, so he decided to return to his room. The heater was not working (and it was in the middle of winter). Steve had told Billy about the faulty heater for months, but Billy never got around to fixing it. There is a local ordinance that requires landlords to repair heaters. Additionally, assume that this jurisdiction includes the implied warranty of habitability. The jurisdiction recognizes constructive eviction, and it follows the majority rule of when landlords are liable for injuries.

Isaac has worked as a staff nurse on the telemetry floor for over 15 years. He holds seniority in the unit. His patient care is satisfactory; however, his interpersonal behaviors are becoming an increasing issue for his coworkers. He throws papers around the unit, gives short answers to questions, and seems generally miserable. He tells the staff that they are lazy and stupid. He is constantly questioning their decisions. You have come from another local hospital in the role of the assistant nurse manager. Based on your observations, you have met with Isaac informally and discussed his behaviors, but they have not changed. Now three new nurses have already come to you saying that this unit is a great match for them, except for one problem. Although they have not identified Isaac by name, they have told you that one of the nurses is extremely abusive verbally, and they have been calling in sick on the days they are scheduled to work with this person.

You Decide: Robbery

Michael Warren Scherz was convicted of first-degree robbery, which in Washington can be committed by the “display” of what appears to be a firearm or other dangerous weapon. Scherz entered a bank in downtown Spokane wearing camouflage clothing and approached a teller and stated that “I need about a thousand dollars. I have a hand grenade in my pocket and I need a thousand dollars.” The teller asked whether he was serious and Scherz responded, “yes.” The teller testified that she was “fearful” and that she gave him $1,000. He placed the money in his pocket and left the bank. The teller did not see a hand grenade or any other weapon. Scherz soon thereafter was arrested by FBI agents in a nearby hotel lobby. He told the arresting agent that at the bank that he had reached into his left jacket pocket and pulled out the end of a set of toenail clippers “just a little bit to see the silver, so she’d think it was a grenade.” The FBI agent seized a pair of toenail clippers from Scherz. None of the bank employees who witnessed the robbery saw the toenail clippers or anything that appeared to be a weapon. Scherz appealed his conviction on the grounds that he did not “display” a weapon. The prosecutor argued that a verbal indication of a weapon satisfies the display requirement. Would you vote to affirm Scherz’s conviction? Is the bank teller’s testimony important in your decision? What if Scherz actually had a grenade in his pocket? Should Scherz be held liable for first-degree robbery if the teller realized that Scherz was threatening her with the metal end of the toenail clippers? What about in the event that Scherz displayed a realistic looking toy grenade?
