I need to do an appellate brief using Georgia as the state.

Review the fact pattern provided below. At this time, Mr. Kant stands convicted of either petit larceny or shoplifting, as dictated by your state statutes, and your office has been hired to handle the appeal. Based on your lessons and reading material regarding legal analysis and writing, legal research, legal citation and appellate procedure, prepare the appellate brief based on relevant statutory and case law from your state of residence. Proper format is outlined in Statsky on pages 600-602, and detailed in your state court rules, formbooks, etc. 

Thoroughly research the issues involved and address the statute/s from your state under which Mr. Kant would be charged and convicted. Locate at least one binding opinion upon which to base your arguments and apply the opinion in a thorough and concise manner. You should also apply any relevant secondary authority that might be used in support of your arguments. In completing this assignment, please focus on demonstrating your research, analysis, citation and writing skills over format of the brief.

Bear in mind that you do not have access to the trial court record for this assignment, which would not be the case in an actual law office setting. Therefore, you may embellish the facts as necessary to fully develop your arguments. Use care, however, not to allow those embellishments to change the issues involved. 

FACTS: Sam Kant, stands convicted of shoplifting/petit larceny (as dictated by your state statutes) from Bilmart, a national department store. At his wife’s request, Mr. Kant went to Bilmart on Wednesday, ______, 20___, and purchased a case of six 4 oz. cans of Hoover’s Baked Beans with Bacon. Upon returning home, his wife chastised him for once again failing to purchase what she had requested. Apparently, Mrs. Kant can’t stand the taste of Hoover’s Beans, but is very fond of the Handell’s brand, and was planning to serve them to her book club when she hosted them for lunch the following afternoon. Mrs. Kant ordered her husband to return to Bilmart to exchange the Hoover’s beans for Handell’s Beans. 

Upon arrival at the store early the next morning, Mr. Kant found that the line for customer service was extremely long due to Bilmart’s annual sponsorship of a major community food drive. In an effort to save time, and thinking the line might be shorter upon his return, Mr. Kant placed the case of Hoover’s beans into a shopping cart, made his way through the store to the bean shelf, and then added the Handell’s beans to the cart. However, upon his return, the line had not diminished and it was obvious that Sam would be waiting a considerable amount of time to formalize the exchange. Fearing the wrath of his wife should he not return in time for lunch, Sam placed the case of Hoover’s beans inside a cart filled with what appeared to be merchandise returns in need of re-stocking. With the desired Handell’s beans in the shopping cart, Mr. Kant then proceeded to the store’s exit. As he neared the doors, Mr. Kant was approached and detained by store security, who witnessed Sam’s actions, and police were called to the store. Apparently, the cart into which Sam had placed the Hoover’s Beans did not contain returned items to be shelved, but rather, donations to the Bilmart Community Food Drive. Officers Kopp and Slickman questioned Mr. Kant and then cited him for Shoplifting.

Writing Assignment # 2: Research Paper

The purpose of this assignment is for you to read, integrate, and write a paper based on primary literature about a topic relevant to communication deviations and disorders.

Paper Requirements

The paper should include all the components listed below. The order does not have to be exactly as it is listed here but be sure to include all the information listed. 

All information from any outside sources must be cited in the paper with references listed on a separate Reference Page in APA style. 

Pick a topic of interest for Research Paper # 2. For each of the following topics, we have chosen one paper. You must choose one of these topics and read the associated paper. All papers are uploaded on canvas.

a. Language 

i. Autism – Joint attention (Murray, Creaghead, Manning-Courtney, Shear, Bean, & Prendeville, 2008)

ii. Brain damage in football players (Stamm et al., 2015)

b. Speech

i. Dysarthria in children with cerebral palsy – (Allison & Hustad, 2014)

c. Hearing

Your paper should address the following:

1. Provide background about the disorder area. Describe the general area (e.g., autism or sports related TBI, CP, etc) as well as the specific topic area (motor disorders in fluency, speech discrimination, student musicians).

2. Summarize the target article (How is it relevant to the topic, as well as other critical information from the graphic organizer)

3. Briefly describe a related paper, and indicate how it pertains to the target study. It might answer a question left unanswered by the target study, extend the results in some way, etc.

4. Be sure to include a reference page titled REFERENCES with all your references. The reference page should include the book you read, the two journal articles, and any other resources you cited. They should be listed in alphabetical order by author in APA format Remember to use sentence case for titles on the reference page, but title case when you cite the name of the book in the text of your paper. When citing references on the reference page, the format should look similar to the following example: Berg, A. O., & Allen, J. (2001). The new U.S. preventive services task force. American Family Physician, 64, 1945-1946.

You must have a minimum of 3 references, as indicated below.  

a. Research paper selected from the list provided

b. Find information on the ASHA website describing background information about the disorder area. You may also use information from the text book or review articles. 

c. Find another research paper related to the same topic. The paper must provide new data, not be a review or meta-analysis. The publication year should be 2008 or later (ie, no studies > 10 years old). Briefly describe this paper, and indicate how it pertains to the results of the target study. 

Rules

The paper should be paginated, double-spaced, using 12-point Times New Roman Font and 1 inch margins. 

Be sure to include a cover page with the name of the paper, and the date. Do NOT write your name on your paper. We want to be able to grade “blinded”.

This paper should be three to four pages. NO EXCEPTIONS. 

Papers should be written in the past tense. 

Do not use direct quotes from reference sources; paraphrase or summarize information and then cite the reference. Under no circumstance should you include direct quotes in this paper.

Prior to beginning work on this discussion, read Chapters 9 and 10 in the textbook, the required articles, and the required videos for this week. The WAIS-IV is a commonly used standardized intelligence test for adolescents and adults.   Assume you have been asked to evaluate an inpatient and have very limited time so that you can administer only 3 subtests from the WAIS-IV.  The referral question is to determine the likelihood that the subject will be able to return to work. In your discussion post, you must describe the subtests you selected and thoroughly explain the rationale for your choice.  In your rationale be sure to describe the properties and applications of the standardized intelligence test subtests selected as they apply to your assigned client. Identify at least one methodological consideration concerning the reliability and validity of administering the chosen subtests. Explain what modifications you would make (if any) to your choice of subtests if you found out your client had less than a high school education or was not a native English speaker. Give examples of arguments for and against the use of standardized tests to make predictions about future performance and apply these arguments to your specific assigned client. In addition to the required reading, research a minimum of one peer-reviewed article from the Ashford University Library to support your choice of subtests.
